Terms for Website Use and Services

Terms & Conditions

These Terms and Conditions explain how E-commerce Automate provides e-commerce automation, marketplace management, account support, and related services through ecommerceautomate.com.

01

E-commerce Automate Terms & Conditions

Welcome to E-commerce Automate. By using our website, signing up with us, purchasing a package, or becoming a client, you agree to be legally bound by these Terms and Conditions, including any terms incorporated by reference.

If you do not accept these Terms and Conditions, you may not use our website or services. E-commerce Automate may revise these Terms and Conditions at any time by updating this page. You are responsible for reviewing this page periodically.

02

Terms of Use

These Terms apply to all services provided by and related to E-commerce Automate, including e-commerce automation, Amazon FBA support, Walmart marketplace management, Shopify dropshipping, TikTok Shop setup, Facebook Marketplace, YouTube automation, virtual assistant support, account reinstatement, consulting, and any related website content or service communications.

We reserve the right, in our sole discretion, to pre-screen, refuse, pause, or remove any project, request, or user-provided content that violates these Terms, appears unlawful, infringes another party's rights, is abusive or defamatory, or is otherwise objectionable.

We may access, preserve, and disclose account information, client information, or project content when required by law or when we believe it is reasonably necessary to comply with legal process, enforce these Terms, respond to support requests, address claims, prevent fraud, or protect the rights, property, or safety of E-commerce Automate, its clients, users, partners, or the public.

03

Services and Project Technicalities

E-commerce Automate provides service packages where clients share business goals, platform details, onboarding briefs, marketplace information, account access, product preferences, budget requirements, timelines, and other instructions needed for the selected service.

Based on the package selected, we may provide research, setup plans, store or marketplace configuration, listings, automation workflows, virtual assistant support, account support, reporting, management, or other deliverables. Service outputs are created iteratively through onboarding, review, feedback, revision, and approval cycles.

You are responsible for providing complete and accurate information, timely approvals, required credentials, marketplace permissions, payment access where applicable, and any third-party account access needed to perform the service. We are not responsible for delays, rejected work, incomplete setup, or platform issues caused by missing, inaccurate, delayed, or restricted client information.

04

Review, Revisions, and Acceptance

When E-commerce Automate provides a strategy, plan, setup, report, draft listing, account work, campaign work, workflow, or other deliverable, you are responsible for reviewing it promptly.

If you do not promptly notify us that a deliverable is not reasonably aligned with the agreed package, onboarding brief, or approved scope, the deliverable may be deemed accepted. If you request revisions, your revision request should include clear details about the requested amendments.

Revision cycles are intended to move the project forward within the selected service direction. Major platform, business model, product category, service scope, or strategy changes may be treated as new work and may require additional fees or a separate agreement.

05

Eligibility, Access, and Permitted Use

To become a client, you must be at least 18 years of age, agree to these Terms and Conditions and our Privacy Policy, and provide accurate registration, billing, and project information. If you register or purchase services on behalf of a company or other entity, you represent that you are authorized to bind that entity to these Terms.

You may access and use our website and services only in accordance with these Terms, posted policies, and applicable law. Any use of the website or services is at your sole risk and responsibility.

06

Prohibited Uses and Website Security

You agree not to use the website or services to transmit, store, or share material that:

  • Violates copyright, trademark, trade secret, privacy, publicity, or other rights.
  • Is unlawful, obscene, defamatory, threatening, harassing, abusive, hateful, or misleading.
  • Contains viruses, malware, harmful code, or systems intended to damage or intercept data.
  • Constitutes unauthorized advertising, spam, chain letters, or pyramid schemes.
  • Violates any marketplace, payment processor, advertising, or third-party platform policy.
  • Uses false registration information, accesses accounts or data not intended for you, interferes with the service, overloads infrastructure, scrapes or automates website access without permission, attempts to reverse-engineer any website software, or tests, scans, or breaches security measures without authorization.
07

Operation of Website and Services

We intend to use commercially reasonable efforts to keep the website and services available, but we do not guarantee that they will be available at all times or error-free. Server issues, telecommunications problems, maintenance, platform restrictions, third-party outages, or other circumstances may interrupt or delay access.

E-commerce Automate may discontinue, modify, suspend, or change the website or any service in whole or in part at any time. We are not responsible for loss, cost, damage, or liability resulting from delays, interruptions, errors, omissions, service changes, or unavailability.

08

Refund, Cancellation, and Tax Policy

Refunds and cancellations are handled according to our Refund Policy. Your refund eligibility may be affected if a special package was chosen, the primary strategy or service direction was approved, revisions were requested, cancellation was for reasons unrelated to our company, required information was incomplete, another provider was engaged for the same project, or the refund request period has passed.

Certain services and costs are non-refundable, including but not limited to third-party platform fees, ad spend, supplier costs, domain registration, hosting, software subscriptions, marketplace fees, rush service fees, and work already initiated or approved.

Customers may not be eligible for a refund after a contract has been sent, signed, or left unsigned beyond the stated review period without a valid reason. All prices advertised on this website are exclusive of applicable taxes unless stated otherwise.

For full details, please review our Refund Policy.

09

Payments and Billing

Payments made by Visa, Mastercard, American Express, Discover, PayPal, bank transfer, cheque, or other accepted methods may be processed by third-party merchant services or payment processors. E-commerce Automate does not store customer card details on its own systems. Where recurring billing is required, payment details may be stored securely by the payment processor or merchant service.

You authorize us and our payment processors to charge agreed fees, recurring service fees, package balances, approved add-ons, rush fees, third-party pass through costs, or other amounts associated with your selected service.

10

Ownership and Rights to Use

Except as expressly provided in these Terms, E-commerce Automate owns all right, title, and interest in the website, service materials, text, images, interface elements, processes, systems, templates, internal methods, and proprietary content.

By submitting business information, onboarding details, account information, brand materials, product information, media, or other client information, you grant E-commerce Automate and its agents the rights necessary to use that information to provide the requested services, maintain records, communicate with you, troubleshoot issues, and complete project work.

Subject to full payment and compliance with these Terms, you will own the final approved deliverables specifically created for you, except for third-party materials, platform-owned assets, licensed software, templates, internal processes, unselected drafts, research not released to you, and proprietary workflows retained by E-commerce Automate. No trademarks, copyrights, marketplace approvals, or registrations are guaranteed unless expressly included in a written agreement.

We may use project information, completed work, results, or deliverables for internal, archival, training, reporting, and promotional purposes unless a separate written non-disclosure agreement states otherwise.

11

Client Responsibilities and Platform Compliance

You are responsible for complying with all laws, marketplace policies, payment processor rules, tax obligations, advertising policies, platform terms, supplier requirements, and account rules applicable to your business.

Marketplace platforms such as Amazon, Walmart, Shopify, TikTok, Facebook, YouTube, and related third parties control their own approval, suspension, reinstatement, listing, payment, fulfillment, and enforcement decisions. We may assist with setup, management, support, or appeals, but we do not control or guarantee third-party platform outcomes.

12

Non-Disclosure and Privacy

E-commerce Automate intends to use commercially reasonable efforts to follow its Privacy Policy. However, we cannot assume responsibility or liability for every unauthorized access event, malicious act, third-party breach, or misuse of information submitted through the website or third-party platforms.

For full details about data collection, use, and rights requests, please review our Privacy Policy.

13

The website or our services may reference or use third-party websites, platforms, tools, payment processors, marketplaces, hosting providers, software, suppliers, or other services. These third parties are not under our control, and we are not responsible for their content, policies, availability, updates, fees, decisions, or actions. If you access or use third-party services, you do so at your own risk.

14

Warranty Disclaimers

The website, services, deliverables, reports, recommendations, and support are provided on an as-is and as-available basis to the maximum extent permitted by law. E-commerce Automate disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, error-free operation, and any warranties relating to delays, omissions, or third-party performance.

We do not guarantee revenue, profit, sales volume, account approval, account reinstatement, platform ranking, advertising performance, supplier availability, marketplace eligibility, or any particular business outcome.

15

Indemnification and Limitation of Liability

You agree to defend, indemnify, and hold harmless E-commerce Automate, its affiliates, officers, agents, partners, employees, and service providers from claims, demands, damages, liabilities, losses, and expenses, including reasonable attorneys' fees, arising from your violation of these Terms, your use of the website or services, your business activity, your marketplace accounts, or your infringement of another party's rights.

To the maximum extent permitted by law, E-commerce Automate shall not be liable for consequential, incidental, special, exemplary, punitive, indirect, or business interruption damages, including lost profits, loss of data, loss of revenue, account suspension, marketplace action, supplier issue, delay, or loss of use. Our total liability for damages shall be limited to the total amount you paid to E-commerce Automate for the package or service giving rise to the claim.
